Because e-discovery has the potential to provide parties with access to vast amounts of information previously unavailable in paper-based discovery, courts are confronted with the task of developing and imposing the proper constraints on its scope and associated costs.

This section presents recent case law where courts issued discovery orders defining the scope of e-discovery. Particular emphasis is placed on cases and materials which discuss the reasoning and analysis involved in tailoring the discovery orders.
