Grants Practice

Cohen Mohr represents grantees and contractors in federal and state grant, cooperative agreement, contract and subcontract matters.

  • Grant and Cooperative Agreement Applications.  We review grant applications together with the applicant’s proposal team to spot legal issues that can impact the grant process.
  • Grant and Cooperative Agreement Awards.  In the right circumstances, we represent a grantee in a court action to overturn or defend the grant award.
  • Regulatory Compliance.  We review the grant award and help the grantee comply with the agency’s requirements and those set forth in the grant, and documents incorporated into the grant.
  • Grant Administration.  We help grantees with problems arising during grant performance, such as changes to the grant scope or funding.
  • Direct and Indirect Costs.  We assist grantees with direct and indirect cost matters.  We usually work in tandem with the grantee’s accountants, or can recommend accountants conversant with cost principles.
  • Audits.  We assist grantees responding to audits.  Again, we often work together with the grantee’s accountants.
  • Procurement of Goods and Services.  Grantees often need to buy goods and services to perform under the grant.  We help grantees decide whether to issue a solicitation for a cost, time and materials or firm fixed price contract, and assist with the drafting of the request for proposals and the award process.
  • Subcontracts.  We represent grantees in the drafting and negotiation of subcontracts, subcontract administration, subcontract modifications, and disputes.
  • Close out and post-grant transition.  At the completion of the grant project, we help grantees with close-out and post-grant matters, such as the retention or transfer of software and systems developed under the grant.
